Not only is the market rigged, but manipulated by the banksters with deep pockets. You should have said more than that.
I am sorry to say, but you are absolutely wrong with the “mens rea” comment. In order to prove recklessness the court will usually take an “objective” view of the decision taken, and compare it to how a “reasonable’ person in that capacity would have taken that specific decision.
The “mens” rea element is primarily used for criminal cases that includes murder or robbery. Recklessness deals with the law of tort, rather than the law of crime.
